Welcome to Build an App Factory. By purchasing, booking, or using our services, you agree to the following Terms and Conditions. Please read them carefully before placing an order or beginning a project with us.
1. Services Provided
Build an App Factory provides creative and business services, including but not limited to:
* Custom app development
* Website and digital design services
* Graphic design
* Printing services
* Branding and marketing services
* Promotional materials
* Business consulting and digital strategy services
The exact services included in each project will be based on the client’s invoice, proposal, service agreement, package description, or written communication with Build an App Factory.
2. Project Scope
Each project will be completed according to the agreed-upon scope of work. Any services, features, revisions, add-ons, or requests outside of the original agreement may require an additional fee.
For app development, website design, marketing campaigns, and custom creative work, timelines may vary depending on project size, client response time, revisions, technical requirements, and third-party platform approvals.
3. Payments
Payment terms will be provided at the time of booking or invoicing. Depending on the service, payment may be required in full or through a deposit/payment plan.
Work may not begin until the required payment or deposit has been received. Final files, printed products, website access, app delivery, or completed project materials may not be released until the balance has been paid in full.
4. No Refund Policy
All sales are final. Build an App Factory does not offer cash refunds, payment reversals, or cancellations once a service has been purchased, a project has started, design work has begun, materials have been ordered, or printing has gone into production.
This policy applies to all services, including but not limited to app development, design services, printing, marketing, branding, consulting, digital products, custom orders, and service packages.
5. Satisfaction Guarantee and Store Credit
We want every client to be satisfied with the final result. If there is an issue with your order or service, please contact us so we can review the concern and work toward a reasonable solution.
Because we do not offer refunds, approved concerns may be resolved through revisions, corrections, replacement services, reprints when applicable, or store credit at the discretion of Build an App Factory.
Store credit may be used toward future eligible services or products offered by Build an App Factory. Store credit has no cash value and cannot be transferred, exchanged for money, or applied to unrelated third-party costs.
6. Printing Services
For printing orders, clients are responsible for reviewing and approving all designs, spelling, names, dates, phone numbers, addresses, colors, quantities, sizes, and layout details before production begins.
Once a file has been approved and sent to print, Build an App Factory is not responsible for errors that were present in the approved file. Reprints due to client-approved errors may require an additional fee.
Printed colors may vary slightly from what appears on digital screens due to differences in screen settings, paper type, ink, printing methods, and material finishes.
7. App Development and Digital Services
For app development, websites, and digital projects, the client is responsible for providing accurate content, images, account access, login credentials, brand assets, written copy, and any information needed to complete the project.
Build an App Factory is not responsible for delays caused by missing information, delayed client responses, third-party platform issues, app store review delays, hosting issues, software updates, or changes made by outside platforms such as Apple, Google, Firebase, HighLevel, payment processors, domain providers, or other third-party services.
App store approval is not guaranteed, as final approval is controlled by the app stores and their review policies. If an app is rejected, Build an App Factory may assist with reasonable corrections based on the original project scope. Additional features or major changes may require additional fees.
8. Marketing Services
Marketing services may include design, strategy, social media content, branding, promotional materials, campaign setup, or related services.
Build an App Factory does not guarantee specific sales, revenue, follower growth, engagement numbers, business results, or customer conversions. Marketing results depend on many factors, including audience, budget, offer, consistency, platform algorithms, market demand, and client participation.
9. Revisions
Revisions are intended to refine the agreed-upon project, not to create an entirely new concept or service. The number of included revisions may vary by package or agreement.
Additional revisions, major design changes, new requests, or changes made after approval may require an additional fee.
10. Client Responsibilities
Clients agree to provide accurate information, timely communication, necessary approvals, and required materials for the project. Delays in communication, approvals, payments, or content submission may delay the project timeline.
The client is responsible for ensuring they have the legal right to use any logos, images, music, videos, written content, trademarks, or other materials provided to Build an App Factory.
11. Ownership and Usage Rights
Once the project has been paid in full, the client may use the completed final design, printed materials, website, or app deliverables for their intended business or personal use.
Build an App Factory may retain ownership of editable source files, development files, templates, project frameworks, backend systems, coding structures, and design drafts unless otherwise agreed in writing.
Build an App Factory reserves the right to display completed projects, screenshots, printed materials, logos, websites, apps, and designs in our portfolio, website, social media, marketing materials, or promotional content unless the client requests confidentiality in writing.
12. Third-Party Fees and Services
Some projects may require third-party services, including but not limited to app store developer accounts, hosting, domains, software subscriptions, payment processors, stock images, fonts, plugins, email platforms, CRM systems, printing vendors, or advertising costs.
The client is responsible for all third-party fees unless otherwise stated in writing. Build an App Factory is not responsible for changes, outages, price increases, policy updates, or service interruptions caused by third-party providers.
13. Project Delays and Abandoned Projects
If a client fails to respond, provide materials, make payments, or approve project stages within a reasonable time, the project may be delayed or placed on hold.
Projects inactive for more than 30 days due to lack of client response may be considered abandoned. Reactivating an abandoned project may require a restart fee or an updated project quote.
14. Cancellations
Because services are custom and time-based, cancellations do not qualify for refunds. If a client chooses to cancel a project after payment has been made, any approved remaining value may be issued as store credit at the discretion of Build an App Factory.
15. Limitation of Liability
Build an App Factory is not liable for indirect, incidental, special, or consequential damages, including loss of revenue, business interruption, lost data, missed deadlines, account suspensions, platform issues, or third-party service problems.
Our total liability for any claim related to a project or service shall not exceed the amount paid by the client for the specific service in question.
16. Changes to These Terms
Build an App Factory may update these Terms and Conditions at any time. Updated terms will be posted on our website or provided upon request. Continued use of our services after changes are made means you accept the updated terms.
